I do not see an issue abandoning it by separate instrument given that we will record a new plat that shows the abandonment on it. However, an easement abandonment would need to go to
the city council. We would need to get the wording from the City Attorney, a legal description and exhibit from your surveyor and place it on the council agenda. If we can gather
that information prior to September 6 we can place it on the September 13 council meeting. The next meeting after that is September 27.

Clay,
We are ok with processing a revised plat once all of the utilities and fire hydrants are set to get easements cleaned up. However, I still need to have the current utility easement
on the west side of the project (which was intended for the sewer lateral that will now be relocated) abandoned prior to closing so there is no conflict with the easement and the building
footprint.
1. Does that plan work for you?
2. What would the process be to get that easement formally abandoned and how long will that take? Our closing is set for Sept 21, but it will probably get pushed back a week.
If the easement abandonment will take longer than that I need to work on another strategy.

Processing a final plat at the end of construction may be acceptable but I need Daniel to weigh in on issues related to title etc…
As far as the fire lane, I will check it, but I don’t think it was ever designed for a WB50 vehicle. To do so could require a significant site plan change. I need to check this and
get back to you.

We actually do not require that private sewer laterals be placed in an easement, but fire hydrants do. Based on the comments from the Fire Department, it looks like a replat is in order.
We can process it near the end of construction incase there are other problems that we need to address. Does this sound like a satisfactory solution?

Clay,
Please see the attached sketch.
With the new building footprint we have a small encroachment on a non-exclusive utility easement dedicated with the previous plat (blue). In the previous design that easement was for
the purposes of a sanitary sewer lateral to serve the proposed building.
With this new plan we are proposing the change in red which will require a modification to the design plans and dedication of a new easement.
Can you outline the city process and timing to abandon the existing easement? We need to abandon the easement to eliminate the encroachment with the new proposed building design. I
am assuming we would need to prepare a separate instrument document for abandonment but wanted to confirm that with you, as well as how long it would take to get Town approval and recording.
