Since it is apparent that the line was not constructed in the location shown on the plans, the plat stipulates that the easements follow their installed locations. Therefore, the screening wall needs to slide over so that there is at least 5' between the waterline and the screening wall. For example, if the waterline was to be centered in a 10' easement and it is constructed 5' outside of the easement, then the easement slides over 10' to encompass the waterline and thus the screening wall also needs to slide over by 10'. This would leave 20' between the right-of-way or back of curb in this case and the screening wall. I am not sure how the waterline got constructed so far away from its design location. It has to either be a construction staking issue or a problem with the contractor. Regardless, it appears to have happened in a number of locations throughout the project. Even more troubling is that we did not find any tracing wire on the waterlines, which will make them virtually impossible to locate. Anytime the screening wall contractor is placing a screening wall in the vicinity of a waterline, it would be prudent to let us know so we could have a utility crew on standby. Secondly, I want to make this work for everyone but what are the easements for if construction can't happen within 10' of the physical location of the main? That effectively makes it a 20' floating easement. Lastly, typically easements and main lines can be crossed at a 45-90 degree angle, does that apply in Addison?
