I have read the statement. My understanding is that the CLOMR changes the game slightly. FYI…It is LOMR not LORM. Please check your maps because I believe that the file is incorrect. When I discussed this with FEMA they thought that the building was close to being in the floodway and therefore wanted you all to sign the community acknowledgement form. The only thing that it is stating is that construction took place in accordance to regulations. The CLOMR that has been approved stipulates that the floodplain and channel were being rerouted. Last time I was there it is pretty obvious that the culverts that were acting as low water crossing had been removed and that the channel has been relocated. Granted all the work is not complete but the form is not stating that has been done. It appears that FEMA is correct that a portion of the Phase 1 Building lies within the current regulatory floodway. Once the LORM process is complete and reflects the relocation of the floodway, it will reflect that the building is no longer in the floodway. We disagree that any of Savoye 1 has been constructed in the regulatory floodway and have talked to FEMA about it. I spoke with Dave Barley, the FEMA reviewer, that generated the request for community acknowledgement. He compared the approved CLOMR work map, the survey that showed the floodplain, floodway and property lines, with an overlay of the FEMA firm panel. He feels that the property line close to the bridge crossing of Ponte Avenue is close to the floodway and therefore they want the form signed by the community so they can have a comfort level that if any improvements were constructed close to the floodway that proper methods were observed. Just as a reminder, FEMA approved our CLOMR that is reflecting a great deal of improvements and changes to the regulatory floodway through this reach. Once the improvements are complete we will be required to submit a LOMR for approval and formal revision of the FIRM map. The LOMR-F will remove the finger of floodplain that projects into the park parking lot south of the building. If you will email me a signed copy, I can email it to Mr. Barley and he will finish up the LOMR-F request.
