As a follow up to last nights email, I called Bryan Hackett with Acme Brick who sells the Pinehall pavers you had approved. He told me this morning that I should tell you that the Pinehall pavers could be here in 8 weeks. I want to recap what directions I understand need to be taken to finish this job and what I need. First and foremost it sounded to Matt and I that the pavers were accepted. As I was leaving Clay you hesitated when I asked to confirm that point. You wanted to see the lines better. That has nothing to do with the pavers being accepted. We gave you test results proving the superiority of the paver and you stated that had the paver been submitted through the proper channels that you would have approved them. Help me understand that point, are they approved or not? If they are not approved by you then there would be no use in trying to correct the punchlist as we are trying to help Steve get this finished with the least amount of delay or money. Steve, you and Matt were going to send me a copy of the payments and lien releases to help me in my fight with Forcecon. To date I have never seen this. You say they were paid but I have no proof. This will help my attorney with the suit. I will need this asap as there may be few assets we can go after. This will assist me in my decision on going forward. Steve, you repeatedly stated that I was not going to be paid for my invoice and that whatever was left in the retainage will be divided up by the courts or a judge. This sounds like it will take a good bit of time. I thought time was of the essence. What other options do you have to pay me? I will need something from you that states how you will pay my invoice. Projects do go over budget sometimes and I am sure you have a contingency set up or should have. Finally. If the pavers are approved them I will ask Rafael to supply me at no charge enough pavers to complete the border treatment and the punch list items. To grind the concrete sub-base to the proper depth and sawcut the concrete to straighten the edges can be a couple of thousand dollars in time and equipment. The border treatment would take a couple of days. The line control will be brought to spec but I must make you aware that the paver alignment for 95% of the job is well within specs and that by your plans Matt I can have up to a ¼” gap on each and every paver (see your vehichular brick detail) and you all can attest that that was the case for over 99% of the installation. The rest is purely subjective and I can show all of you many areas that are worse than this installation around the Town. The tack coat is coming up through the pavers in numerous locations around the Town of Addison. This is not abnormal for this type of installation in Texas heat. I am working you a quote up for the removal of all of the pavers and asphalt bedding and grinding of the concrete as well as sawcutting as needed to be ready for proper installation. Remove and haul off existing pavers and asphalt: $1.50/sf @3100 sf = $4650.00 Rework concrete: = $2000.00 Purchase new Pinehall pavers 3400sf @ $6.73/sf = $22,822.00 New asphalt, tack coat and labor to install pavers @$4.50/sf = $13950.00 Total $43,422.00 Acme brick will be asking for a up front payment on the pavers before they are shipped. In closing, I would hope that you see that it is better to work together than to spend more of the projects money than it has if that is the case. Michael L.
