Please see attached my proposed language in the Special Provisions, Bid Proposal, and Contract Agreement concerning the requirement to meet the intermediate deadline of completing the
wind energy system by the April 30, 2012 deadline required for the SECO grant.  I have highlighted the pertinent language in yellow.  In speaking with Eric Lamon at Landmark, he suggested
that the Contractor’s penalty for not meeting that deadline be substantial, but not the full $500,000; if the penalty provision is $500,000, the Contractor will likely bury a substantial
risk dollar amount in their bid, and potentially offset the grant.

 

I recommend the penalty to be $200,000 as shown in the attached.

Can we phone conference with Mary-Jo to get a complete description of what must be complete by April 30, 2012?  My current thought is that it should include full completion, testing,
acceptance, except for final connection to the power company’s grid.  Other electrical items will be ongoing after completion of the wind energy system, so I didn’t want to tie them
down to making the connection to the power company until the other items were finished.
