Here are some of my thoughts: 1. I don't have issue with the milestone payment setup for the wind energy bid item 62, as long as they provide the documentation they indicate. 2. In lieu of determining a cap on "credit forego" for value engineering items by detailed accounting of their additional costs for the 9th wind turbine, they are proposing a cap maximum of $75,000. I asked Jim why they couldn't provide a detailed time and materials type accounting for this additional cost, and he said it would be impossible to do this and they are not set up to do that. I asked him a couple of times about this, and he remained insistent on it. 3. As part of the credit forego per above, they basically want a guarantee on removing the 2nd floor enclosure and on use of cable trays instead of conduit, but if those value engineering changes can't be made, then they want the City to pay them $20,000 as part of the offset to their additional wind turbine costs. I told him that we can't make a recommendation yet on these 2 value engineering items until my electrical engineer gets back from vacation, and that tying the change order to a payment of $20,000 may require Council action. He still wants it in the change order. This $20,000 would be included in the $75,000 cap. 4. They want a liability release on what the pedestal may look like if we go forward with the light sandblast of the pedestal. We are working with Brad Goldberg on a final recommendation of whether or not to sandblast, but this is to include Landmark doing a test blast on the lower portion of the pedestal that will be covered with the aluminum cladding. I told Jim that this should be a separate issue and should not be tied to this wind turbines change order. Please let me know how you would like for us to proceed on this.
