Question; are other airports solicited for comments or has this requirement been satisfied by the public notice? Also, I assume that any public comments are addressed during this evaluation. Is this a correct assumption? All public-use airports within 13 NM of the site are sent the public notice. If the proposal has not impact on their airport, we never get any type of response from these airports. All public comments are evaluated to determine if the comments are aeronautical in nature or simply personal in nature. All comments are acknowledged in our final determination letter. This process is estimated to take 40 days to complete, however, this process may take longer. Question; is there a maximum time for completion? The “Notice of presumed hazard” states that the formal aeronautical study requires a minimum of 90-120 days. The time period goes like this, public notice is issued, with comments due in 37 days. Once the final determination is issued, it does not become final until 40 days after the date of the determination. This allows anyone who commented on the public notice to petition FAA HQ to review the determination. I plan on issuing the determination just a day or two after it comes off public notice.
