I am available at your convenience to talk over this project. 1. During my deposition, Bankston’s attorney asked me what alternative there might be to the channel improvements that we designed for the T own. At the time, I had not considered the matter. The thought that came to mind was raising the site which was the reply I gave. 2. Later during the mediation, I mentioned to Robert that another possibility was to improve the channel primarily on the Bankston property. This would require some minor grading on DART’s property to tie things in and was not likely to achieve a 100-year flood protection for the existing structures, only something better than exists today. Robert did not want me to muddy the water by mentioning this to Bankston 3. I don’t believe that the Nave flood study accurately represent the 100-year storm when it assumes that all of Bankston’s existing property is ineffective flow area. The grades are lower than the 100-year storm in the parking lot and on the building foundations, consequently, water flows through the property, outfalling into the channel between the two buildings. Also , the Nave study does not consider valley storage which will be reduced if a retaining wall is built on the property line to block flow. 4. I don’t think that the hydrology is as significant an issue as the hydraulics so we’ve not reviewed Nave’s revised hydrologic calculations. I expect that we can come to terms with the hydrology if the hydraulics can be worked out. 5. If I were trying to get the property out of the floodplain, I would look at improving the channel on Bankston’s property and raising as much of the site as I could without increasing the floodplain elevations or reducing valley storage. I suspect that there may be some combination of channel improvements and fill that would work. 6. Based on our previous meeting with Ron, I’m not sure how proactive the Town wants to be in making suggestions to Nave. I hope this helps.
