Clay, I wanted to follow up on a conversation we had regarding the EPA Temporary Certificate of Occupancy for their location at 16650 Westgrove Drive in Addison, Texas. It was my understanding that the Temporary Certificate of Occupancy for the space would allow the tenant to move in and began operations. It was also discussed that the Temporary Certificate Occupancy was issued to ensure that the exterior work for the EPA Project (under separate permit) would be completed in a timely manner. The Landlord and Contractor have agreed that all exterior work will be completed by October 1, 2009. I have attached the contractors schedule that reflects a completion date by October 1, 2009. My understanding is that a Permanent Certificate of Occupancy will be issued when all exterior work has been completed and approved by the city. All parties also understand that the City of Addison may elect to revoke the Temporary Certificate of Occupancy for the Interior Space and evict the tenant if the exterior work is not completed by October 1, 2009. Please let me know if the above statements are also your understanding of the conditions for the EPA's Temporary Certificate of Occupancy. Thank you for your assistance in this matter.
