I spoke with Lewis late yesterday morning, and he said that the visit went ok, but that the property owner was not present and so answers needed to complete the Phase I were not given. If I recall from our conversation, Lewis said that the attorney for the property owner, Charles Salazar, stated that the owner wasn't interested in responding to questions, but to submit them in any event. Following the meeting, I received a copy of the following e-mail from Trent: As a response to our conversation at the Site this morning, I’ve provided written details regarding the typical interview of a landowner for a Phase I Environmental Site Assessment (ESA). The goal of the interview would be to establish/confirm the following: 1) length of ownership, 2) types of operations at the Site (current and historic), 3) operations prior to current ownership, 4) previous owner’s contact information, 5) knowledge of and details related to the presence of and uses for chemicals/hazardous materials/asbestos (details would include location of hazardous operations, volume of materials used, waste disposal details, etc.), 6) knowledge of releases of chemicals/hazardous materials/asbestos, 7) regulatory agency violations, permits, etc. related to chemical/hazardous materials/asbestos, 8) the presence of reports related to chemical/hazardous materials/asbestos, 9) any knowledge of environmental contamination in the area or the Site, and 10) any clarification(s) required to evaluate concerns that come out of the above questioning. We are revising the ESA slightly to include the observations from this morning. Let me know if you’d prefer to pose the interview questions to Mr. Salazar prior to providing the ESA to them for their review. The fewer the revisions, the less expensive the process will be. I believe Lewis will be submitting these questions to Salazar, and we'll see if a response is received. Lewis and I discussed the possibility of conducting testing around the property, which is something that Ron, Chris and I also discussed in a meeting yesterday morning. I think that Trent Ripley's group would be the ones to conduct the testing, and that will need to be followed up by someone, perhaps Nancy. Would you like me to follow up with Nancy on that? Thanks. We have attempted to get the right to conduct a Phase II site analysis of the property (since it was a gasoline station), but do not believe we will get permission from the court to conduct a Phase II. In an effort to determine if there is environmental damage on the site, we have decided to see if we can determine if there is damage, or report of damage, around it. Our logic is that if there has been an environmental hazard on that site, it might have traveled to adjacent sites. We are prepared to do some testing in the rights-of-way that we own on the east and north side of the property, but thought we might be able to glean some information about the west side from an environmental site analysis you might have done when you acquired the Springhaven Apartments from Folsom.
