Just let me know what you guys want to do. It would be helpful to me to understand why it’s taken 9 months to present this claim. I honestly don’t understand how you can just now know
that you installed something that you didn’t get paid for.

I’ve gone through the change orders too and actually in CO # 3 there was one added to items 237 and 238 as well taking those totals up to 28 which is what was paid. I think that Durable
is saying they installed foundations and furnished the poles for 36 total of the type 1 lights. I’m not positive what is going on with the type 2 poles as there were 4 that were added
but then 6 taken out and moved into phase 1C. this is where it gets confusing, are there going to be 14, 18 or 12 when the project is all complete? Also, I don’t think that Durable
had anything to do with the AT&T manholes on any of these phases.
I will pass your comments along to Durable and see what their response is (cc’ing Patrick on this email). I know that they are willing to walk the site with us and count all foundations
and poles.
Patrick, can you please respond to Eric’s comments and let me know if you would like to walk the site and count the lights.

Andy,
CO 2 took #237/238 from 36ea to 27ea.
CO 4 took #239/240 from 14ea to 18ea.
CO 6 took #239/240 from 18ea to 12ea.
That being said, Durable did not install any of the lights around Savoye 2. I allowed them to just provide the poles and fixtures for Andres to install, but paid them full price….
I will be counting the poles today and respond, but since we are pushing this, I will be expecting a credit for the labor on the poles they didn’t install and I expect them to provide
the ATT manhole that they got paid for that isn’t onsite.

I just wanted to give you a heads up that Durable Specialties is making a claim to us that they were not paid for some of the light poles that were furnished on Phase 1B. They are getting
all of their back-up together now with delivery tickets and other proof that the poles / fittings were actually furnished. I think that they have a legitimate claim on this one. When
I get all of the information, I will pass it along to you for your review. I think the way that Joel / Bruce have done the change orders has messed some of this stuff up on the paperwork
end that caused this mistake.
