Clay, As you know we do not believe it is fair to charge us damages on the striping. You can claim that if we could predict the future two months ago one could have purchased and stockpiled striping materials. Unfortunately this was not done and was not done by any striping firms that perform work in DFW or in the state of Texas. I have attached correspondence sent to us from TxDOT, the AGC and the manufacturer's of the paint which detail the national material shortage and the problems that are occurring not only in Addison but nationwide. We request that the Town of Addison consider this before charging liquidated damages to a contractor that has endeavored to do a good job for the Town on everything thus far. I know you can take the route of interpreting the contract as black and white, but the road is open and serving its intended purpose. Please review the lengthy documentation so you can see that this is not an excuse or questionable tactic to get flexibility on finishing a job on time. Please let me know and we are still taking every action we can to get the material at whatever cost.
