Chris - We have run into an issue at Vitruvian Park in which we could use your guidance. Attached is an e-mail sent to Clay last week requesting an easement along Park Road for some work by AT&T. We need to have this easement in place in the next week to keep AT&T on track for service to Savoye (the first phase). The design team went through several iterations and conversations with AT&T to place the equipment in the most inconspicuous location possible instead of in the middle of the Right of Way. I spoke with Clay on Friday and he feels like his hands are tied and a re-plat needs to go through P&Z and Council which could take up to 60 days because of pushback he thinks he will get from John Hill regarding the easement. Meanwhile, AT&T will not proceed with any work until they have an easement. Therein lies the problem. There is an option to grant AT&T a separate instrument easement which is very common and Clay suggested that you or Nancy may be able to assist with accelerating the process. The language seems fairly sterile as well, but I know it would need to go through legal review. I believe Icon provided the easement language to Clay and he has forwarded it onto John Hill. Time is of the essence and we would like to give direction to AT&T. The phone line installation will affect the telephone, fire alarm and elevator testing, etc. and cause our contractor to delay those areas of the project, which is not favorable for all involved. This new construction will allow AT&T to remove the existing cross box that is in conflict with the proposed Park Road approach & ramps AND will provide the point of service for VP101 and this area of the development. This location has been coordinated with the other infrastructure (water, electric, landscape, etc) in this very congested, but somewhat hidden area. Attached is the exhibit (2 sheets) showing the area equipment layout. Since the Final Plat for Vitruvian Park, Lots 1 & 2, Block A has been filed, the Town of Addison is now the easement property owner and therefore would need to grant the telephone easement for the proposed equipment. Attached, in PDF format, are copies of a Final Plat exhibit showing the area of the easement, an exhibit showing the limits of the proposed AT&T surface & underground telephone easement tracts AND the proposed AT&T blank "Equipment Station Easement with Underground Lines" easement language for your review. We are preparing the legal description and exhibit to be attached to the easement language but would like the Town to begin the easement review process now. I have read the easement language and do not see any items that are not necessary for the proposed equipment. I will need the Town of Addison typical signatory for this easement. Please provide at your earliest convenience. Please let me know if you see any problems with the Town of Addison granting this easement. Telephone service to VP101, in a very tight time frame, is dependent on us providing an easement for the proposed equipment. Please let me know if you have any questions or need additional information.
