Clay – I was finalizing Change Order Number 5 for the Park contract and just wanted to get your opinion of the outside walls just downstream of the weir structure at Ponte Bridge. As you know, North Texas Contracting (through Rebcon) is saying that these walls should be an extra to the contract. Viewtech is adamant that the drawings have always shown these walls and nothing has changed. The following excerpt is from the Special Provisions section: FALSE WEIR STRUCTURE BENEATH PONTE BRIDGE: The lump sum bid for “Weir Structure Beneath Ponte Ave. Bridge” shall be all inclusive for structural concrete for the weir walls, concrete cap, downstream splash and energy dissipation pad with 2” grouted beach pebble lining, and shall be full compensation for furnishing all labor, tools, equipment, materials, and incidentals necessary to complete the work as shown on the drawings (Ref. Sheet SP303/05 & 06). The Engineer has estimated the following quantities for structural concrete construction: 1’ thick Concrete Wall – 1,500 square feet; 2’ x 8’-9” Weir Wall – 70 linear feet; 2’ x 1’-11 1/2” Weir Wall – 70 linear feet; 1’-3 ½” x 3’-5 ½” concrete Weir Cap – 71 linear feet; and 1’ x 8’-9” Weir Wall – 70 linear feet. The Contractor shall verify or estimate his own quantities for pier construction and base his Lump Sum price for Weir Structure beneath Ponte Avenue Bridge accordingly. The quantity breakdown included in this description does not include quantities for the two walls in question. On the other hand, the contractor was to verify or calculate his own quantities for his LUMP SUM bid for this item. I have gone back and forth on this myself as to whether this should be an extra. Victor on the other hand thinks this is solely something the contractor missed. On the quantities that we (Icon) prepared for Civil related work, we had included this section in the Lake Edge Wall (4’ AFG) quantities, which after reviewing the Structural drawings, this is obviously not correct.
