Bill has reviewed the modeling and the previous correspondence and we actually just went over his letter response together. We will be sending UDR a letter response later this evening or first thing in the morning with our evaluation and recommendation. In short, Icon's responses on previous correspondence and modeling were contradictory. There was correspondence on one occasion saying that area was not to be disturbed and on another occasion it said it was. Our recommendation is going to be what we feel is in the best interest of the project which is that if the slope looks stable as far as vegetation currently - do not disturb it. I have held them off by requiring some additional BMP work (silt fence and a rock check dam) before they can start, but that work will be completed tomorrow.
