By e-mail below I have forwarded to Leonard Hoffman the attached revised draft of the amendment to the Master Facilities Agreement.  The primary change to the draft sent on Friday is
the addition of a new subsection C to Section 2 of the document; the new subsection amends Section 6.B.2.(c) of the Master Facilities Agreement regarding the payment of the construction
management fee, by adding an example.

Leonard, attached please find a revised version of the proposed Second Amendment.  The changes to the draft of the document sent to you on Friday are the following:

 

1.         Changed the title of the document to “Second Amendment,” as I understand that there has been a prior First Amendment;

 

2.         Added a new third “Whereas” clause to reflect the First Amendment; and

 

3.         Added a new subsection C to Section 2 of the document, which provides for an amendment to Section 6.B.2.(c) of the Agreement to add an example regarding the construction management
fee.

 

As with the prior draft, in the interest of time this is being submitted to you simultaneously with submitting it to the Town, and it is subject to the Town Staff’s and Council’s review,
modification, and approval.
