Dallas has signed off on this language and Lea has been working with Farmers Branch to get their approval. She sent a note yesterday afternoon that they are ready to withdraw their

Lisa: Following is the language currently in the permit. It is being reviewed by Farmers Branch and as soon as they approve and remove their protest, Dallas will remove theirs and
TCEQ will issue the permit. We do not anticipate any changes at this point.
* This amendment does not allow Permittee to impound State water in Reservoir No. 2 or additional State water in Reservoir No. 1. Permittee shall provide and maintain suitable outlets
in good working condition in the reservoirs to pass all inflows of State water downstream and maintain the reservoirs full. For purposes of this agreement, full shall mean the top of
dam elevation for each reservoir. For Reservoir No. 1, the top of dam elevation will be 542.00 msl and for Reservoir No. 2, the top of dam elevation will be 544.00 msl. Upon termination
of this permit, Permittee shall activate the outlets such that no State water is impounded in the reservoirs, except that amount previously authorized for impoundment in Reservoir No.
1.
* Permittee shall maintain and operate an alternate source of water with sufficient production to ensure no State water is used as a result of this amendment. Permittee has identified
groundwater from the Trinity Aquifer as the alternate source of water for this project. To account for potential use of State water due to evaporation, Permittee shall supplement the
reservoirs with water from the groundwater well in the amount of a minimum of 5.82 acre feet per year, and this water shall be released over the weir in Reservoir No. 1. Permittee shall
maintain records of the amount of groundwater added to the reservoirs and reservoir water diverted and utilized. Permittee shall provide documentation of same for review during normal
business hours upon requests by either the Executive Director or members of the general public.
As we understand it, this means the reservoirs must be kept in a “full” condition and a minimum of 5.82 acre feet of water must be supplemented in the reservoirs. There may be years
in which more than 5.82 acre feet of water will be added to the reservoirs in order to keep them in a “full” condition.
The reference to the Trinity Aquifer has been in the permit since 2009 and even though we have asked to have it changed to "Trinity / Woodbine," or better yet "groundwater", it remains.
In discussions with Chris Koslowski at TCEQ we were told not to worry, that if it becomes necessary in the future to revise it to a different aquifer, then it could possibly be done
by a simple note to the file. So, once we are sure the Woodbine has sufficient water to meet the permit and irrigation requirements, the Town will ask that the note be added to the
file.
Hopefully this is sufficient information to proceed expeditiously with the design (because it is all I know at the moment) but if something else is needed, let us know. Tom.

I was just checking on your current progress. In accordance with your Meeting Minutes, there were numerous Action Items required. Do you have all the information you requested? If
not, please provide me a list of which items you are still waiting on and I will run them down for you. In addition, you stated that you would have the “Design Criteria Document” ready
for review. Is this documents completed” If not, when can we expect?
I also have a question, would we save any time in the Design Phase if we cut the submission down to two submissions, say a 60% and a Final; with the Final being more of a Pre-Final requiring
just minor edits and Engineer’s Seal. The 60% would need to have the Front End documents fairly complete for the Town’s review. Give me your thoughts…….
