It is attached for your review. As I mentioned in my voice mail, additional funds from Funding No. 1 are being added to construct the Creek Area Park, which leaves fewer funds to be allocated to the remaining Phase I and Phase II improvements. In order to provide some security that any difference in cost to design and construct those remaining improvements will be paid, a provision is added providing for a guarantee from a third party. Some other modifications are also included, in some instances to clarify the terms of the agreement, and hopefully none of which will be an issue. I understand that the objective is to place this item on the City Council’s February 9 agenda. In the interest of time, I’m providing this to you simultaneously with providing it to the Town, so it is of course subject to the Town Staff’s and Council’s review and approval.
