I spoke with Chris Kozlowski at the TCEQ.  He stated that the card with the seal from Dallas County was sufficient for the proof of recording required for the water rights permit.

Lea, I just spoke with Clay, and he said that the County Clerk recorded the permit in the Dallas County records, but that there was a card that TCEQ wanted the clerk to fill out and
the clerk would not fill that out.  Clay did get the clerk to stamp it, and then as I understand it Clay filled in the information on the card and sent it on to the TCEQ.  He’ll follow
up in a couple of days with the TCEQ to see if the card, as filled out and stamped, satisfies what the TCEQ needs.  If the card doesn’t satisfy the TCEQ, let’s re-group and see what
can be done to get them satisfied.

Lea,

 

I filed the water rights permit as well as the Lemons easement at Dallas County this morning.  They would not fill out the card.  The best I could get them to do was to stamp the card
with their seal.  I have placed it in the mail and will give them a call in a few days to insure that they received it and that it is satisfactory proof.

Lea,

 

I spoke with Alyssa this afternoon.  She stated that the courier returned the easement and water rights permit unrecorded because the “clerk did not understand what to do with them.”
 I am not sure what the issue is.  Dallas County records easements everyday, so this should be nothing new to them.  However to insure that they are recorded in a timely fashion, I will
hand carry them to the courthouse tomorrow and have them recorded.
