I don't believe this is an issue and I also believe that the contractor should proceed per the drawings. Please verify. As I understand it, the utility trenches will be restored to grade after the lines are laid. Although the lines were not specifically called out in the permit, the creek impact is already covered by the permit and as long as the lines don't change the grade of the stream bed, I don't see a new fill activity.
