Todd,

We have been given permission by the USACE to continue with the construction of the bridge abutments, with the understanding that all BMPs will be established prior the work proceeding
and maintained through-out the construction period.

Enviro-Serve will advise us shortly of any measures required outside of the ones currently shown 1D SWPPP plan.

achieving the goals of environmental remediation and logical construction
milestones associated with your development.  Your work in the areas outside
the waters of the U.S. referenced below is authorized within the confines of
the enforcement order we issued yesterday; subject to use of proper erosion
control measures to isolate these areas and prevent sedimentation of the
waters of the U.S. in accordance with your permit.  If you have any questions
or there is adverse weather, please contact me and we will help you adapt as
necessary.

We are in receipt of your letter dated October 12, 2010 and I would like to
tell you how much we appreciate you working with us to return this project to
a productive state. Per our conversation yesterday, on top of the work
authorized in the above mentioned letter, we would also like to return to
construction of the following items which are located outside of the waters
of the United States:

 

1.       Grotto fountain

2.       Amphitheater

3.        Stone masonry at the Wildlife Observation Deck

4.       Ponte Ave bridge abutment

5.       Bella Lane bridge abutment

6.       Pedestrian bridge abutment

items.
