I seem to recall Eric Farmer (your EE) mentioning that he had examples of a better MOA with regards to the materials and installation work for the in-pavement MALSR lights. Did we propose those changes? Maybe we should? First is at the top of Page 3, Item 6, “Terminate any and all FAA power and control cables servicing at existing FAA facilities, systems, and/or equipment that are adversely impacted by the Sponsor’s project.” We think this needs some clarification or re-wording. Specifically, the word “terminate” is a concern. There are old power and control cables for the Rwy 15 MALSR system that will definitely be affected. What is the intent of this item? Second, Page 4 Item 12 lists FAA equipment that is expected to be affected by the project. Absent from this list is the 15 LOC and the 33 LOC. Is it assumed that these facilities will not be affected by the work? Third, on Page 8, Item 21, “Provide land rights and enter into no-cost Land Rights Memorandum of Agreement with the FAA for the new or relocated facilities for a 20-year term. This includes the new sites and any access roads, cable routes and/or restricted critical areas. This Memorandum of Agreement(s) shall identify any existing hazardous substance contamination, provide for frequency protection and include non-restoration clauses” … as part of the Sponsor duties, this effectively requires us – preferably through our Engineer (Garver) – to provide property surveys / platting for FAA easements; I think this should be included in the Engineer’s scope of services for the final design work.
