Our ROW ordinance requires the utilities to relocate costs at their expense for road work. If the line is new, our franchise agreement compels them to install that at their cost. However, I am concerned that all this was directed without a clear understanding from TWC what their obligations are before we instructed them to perform the work. I think we need to refuse to pay and put the burden of proof on TWC to show whey they should be reimbursed. If they can show where they can, then I suggest getting John Hill to make a determination.
