As you are aware, the 2008 issuance of certificates of obligation included $6 million for street right-of-way acquisition. That number was based on allocating $3 million
for acquiring property on Addison Road for the eventual construction of a street into the Addison Circle development and $3 million for the acquisition of property to modify the Spring
Valley / Brookhaven intersection. Through 12/31/09, $645,946 has been spent on the Addison Road property acquisition (including demolition of existing structure). We have spent $8,732
in legal fees associated with acquisition of the Spring Valley / Brookhaven right-of-way. So, there is $5,345,282 remaining in this category of funding. We have also generated interest
income from the invested bond proceeds. Through 12/31/09, this amount totals $906,856, and is currently unallocated. Please let me know if you require additional information or have
any questions related to this matter.

As you recall, we sold COs for:
1. Vitruvian infrastructure,
2. the property acquisition of the two tracts on Addison Road, and
3. the property acquisition for the tract at Spring Valley Road and Brookhaven Club Drive.
We ended up spending less than we anticipated on the Addison Road, and even with the demolition of the two buildings, we have money left there. We were going to use it to build a street
through the two tracts, and we put money in for the street, but we are stalled on that and have no immediate need for the street. If we were to sell the land to a developer, we could
require him/her to build the street.
We are in the process of acquiring the property at Spring Valley and Brookhaven, and we find that the reconstruction of the intersection there is going to cost around 2 million dollars.
We have 3 million allocated to purchase the property, and don’t know how much of that will have to go for acquisition.
Our question is, was the wording on the sale of the COs general enough to allow us to take the money left over from Addison Road and use it to reconstruct the intersection at Spring
Valley?
