Clay, From the limited information provided, the firm has a positive working capital balance and limited long-term liabilities for the audited first two quarters and the draft third quarter. So, I would say they appear to be financially solvent. If you want more assurance, I suggest you contact some of their sub-contractors. They would be the first to tell you if the company was not paying them on time and could be evidence of cash-flow problems. Also, aren’t we requiring construction and maintenance bonds for the work? If so, I think our interests are properly protected. Randy From: Clay Barnett Sent: Thursday, February 24, 2011 3:33 PM To: Randy Moravec Cc: Marisa Perry; Matt McCombs Subject: FW: Vitruvian Phase 2 Randy, Attached are the financial statements for CPS Civil. They have been in business roughly 1 year and we are concerned about their financial condition. They have submitted a bid of $862,824.60 for the construction of Bella Lane. They currently have $3.8 million of other projects. Would you or Marisa mind having a look at their financial statement and let me know if in your opinion they have the financial ability to complete Bella Lane in addition to these projects? If you have any questions, please let me know. Thanks, Clay Barnett, P.E. The year end financials are not yet completed so the ’10 3rd quarter is the last completed financials. Regarding the Colleyville Elm street project it consisted of 2950SY of residential street paving. This was a continuous run of street. This project had two specific requirements that did not facilitate the use of a machine. 1- The specifications limited excavation to less than 1’ back of curb and the paving had to be performed half width to allow full access by residents at all times. Mr. Jimmy Brock with the city of Colleyville was our City contact on that project. His number is listed on our project reference sheet. Samuel blvd project was a state project where we performed driveway band sidewalk paving as a subcontractor to Austin Road and Bridge. I look forward to visiting with you this afternoon to further discuss our qualifications for this project. Respectfully Robert Farrow Chief Operating Officer CPS Civil LLC
