Box 9010 Addison, TX 75001-9010 RE: Landmark Crossing Dear Jim: As we discussed today over the telephone, enclosed is a copy of the commitment for title insurance issued in connection with the Landmark crossing property. Schedule A of the Commitment indicates that record title appears to be vested in St. Louis Southwestern Railway Company of Texas. Schedule B of the Commitment lists as exceptions to title, among other things, a Dedication Deed filed November 28, 1973 (recorded in Volume 73252, Page 1476. Deed Records of Dallas County) and terms and provisions contained in an instrument filed November 23. 1993 (recorded in Volume 93228, Page 2284, Deed Records of Dallas County, Texas). These documents are both in connection with the City of Farn1ers Branch. Could your office please review these documents to determine whether or not they affect the Landmark crossing tract? The Commitment is not an opinion or report of your title. It is a contract to issue you a policy subject to the Conunitment's terms and requirements. Before issuing a Commitment for Tide Insurance (the Conunitment) or or a Title Insurance Policy (the Policy), the Tide Insurance Company (the Company) determines whether the tide is insurable. This determination has already been made Part of !hat delerminalion involves the Company's decision to insure the tide except for certain risks !hat will not be covered by the Policy. Some of these risks are listed in Schedule B of the attached Conunitment as Exceptions. Other risks are stated in the Policy as Exclusions. These risks will not be covered by the Policy. AnoIher part of the determination involves whether the promise to insure is conditioned upon certain requirements being met. Schedule C of the Conunitment lists these requirements that must be satisfied or the Company will refuse to cover them. You may want to discuss any matters shown in Schedules Band C of the Commitment with an attorney. These matters will affect your tille and your use of the land. You can also get a brochure !hat explains the policy ftom the Texas Department ofInsura.nce by calling 1-800-252-3439. Before the Policy is issued, you may request changes in the policy. Some of the changes to consider are: -Request amendment of the "_and boundary" exception (Scbedule B. paragraph 2). To get Ibis amendntent, you must furnish a survey and comply with otbeI' requirements of the Company. On the Owner Policy, you must pay an additional premium for the amendment. If, the survey is acceptable to the Company and if the Company's other requirements are met, your Policy will iosunl you against loss because of discrepancies or conflicts in boundary'lines. i ' encroachments or protrusions, or overlapping of improvements. The Company may then decide not to insure against specific boundary or survey problems by making special exceptions in the Policy. Whether or not you request amendment of the "area and boundary" exception, you should determine whether you want to purchase and review a survey if a survey is not being provided to you. -Allow the Company to add an exception to "rights of parties in possession."
