did not comply with the City's ordinance concerning the backfill of old tank pit at the above referenced site. In particular, the area of the Right-of-Way belonging to the Town of Addison
was NOT compacted correctly according the plan approved by the City. You· mentioned that any soil mixed with pea gravel is not going to make compaction possible. This incompliance has
already created the problems for the current contractor, LSI Services, to install the new tanks for Atlantic Oil & Gas Co. In addition, it also has created potential public safety problem
as you indicated. After we complained to ExxonMobil representative, Ms. Celeste Saenze, she indicated that ExxonMobil did submit the plan to the City and City approved it, and City's
Officials did inspect the site after the backfil1 operation completed, and did not raise any objections. Please send me a letter to help us get the story straight. Our position is that,

to complete the excavation at the subject site. You can see how we arrived at this point by reviewing the copy of the letter that 1sent to Atlantic yesterday that you were copied on.
Assuming that this would have been a normal underground storage tank (UST) instaJJation our excavation would have been 25' x 35' x 12' equaling 388 cubic yards ofdisplacement. To transport
388 cubic yards would, under nonnal circwnstances, require nineteen end dump trailer loads at acost of $35.00 per hour per truck. Assuming a typical turnaround time of approximately
two hours for each load the estimated cost would be $1,330.00. LSI Services Company's (LSI) excavator time to excavate this typical tank hole would be approximately ten hours at $75.00
per hour totaling $750.00. The total ofthe afo.l'ementioned calculations amount to $2,100.00:1:. The backfill required to fill the void around the new USTs would be approximately 268
cubic yards. Therefore, by deducting $2,100.00 from the Atlantic invoices, you can arri.ve at the approximate excavation cost that should be Exxon-Mobil's responsibility, excluding,
of course, the backfill required to backfill the remainder ofthe excavation not covered in the previous paragraph. At best this is not a good situation as I have received two calls this
morning from Towll ofAddison concerning the excavation. They have indicated to me that they would backfill. the excavation and let the chips fall where they may if resolution is llOt
reached quickly. Atlantic's position, in my opinion, seems to be that this is not their problem. LSI is prepared to set the (wo new USTs immediately pending resolutio.n on who is going

project at the subject site which require immediate attention by Atlantic Oil & Gas,lnc.(Atlantic), Mr. Shaw Soo (Property owner) and Exxon-Mobil (fonner tenant). More specifically,
during the excavation ofthe old tank hole for the installation ofthe new USTs LSI discovered that Exxon-Mobil had place all the tank hole debris back into the excavation, i.e. chunks
of concrete, steel and pea-gravel. The backfill also had a distinct hydrocarbon odor to it, thus milking it difficult to dispose of in our usual places. However, we did find a place
Lhat would take the material, for an additional. cost. .During the excavation process we also encountered a new problem, the hole was caving in back to its' original shape left by Exxon-Mobit
due to the fact that it had not been compacted in the Right-ofway (ROW) belonging to the Town of Addison. Exxon-Mobil used the original pea-gravel to backfill the excavation thus lnaking
compaction nearly impossible. As a result of the 'use Qfpeagravel the excavati,on has undermined part of the Addison ROW creating problems with some of their traffic sigoal utility boxes.
LSI originally slarted excavating approximately 10' inside the easement line only to have the ho.1e cave in back to its' original shape. The Town ofAddison has now requested that LSI
􀁾􀁤 Atlalltic obtain a Right-of-Way pennit. including, but not limited to, posting a bond and providing liability

prepared to absorb this additional cost, nor is LSI prepared to absorb the additional cost ofthe handling ofthe Exxon-Mobil contaminated soils. However, LSI removed the soils from the
property in your best interests and your requests to complete the project as soon as possible as you were already maki.ng lease payments on the property with no revenue coming in. 1t
is important that we install the two 12,000 gallon USTs as soon as possible and backfiU the excavation in order to prevent any damage to the Town of Addison's streets and utilities.
Ms. Celeste Saenz, Exxon-Mobil representati ve, suggested that LSI stock pill. the contaminated material on the location pending Some resolution, however this was impossible, due to
the lack of storage space. The material has been removed from the property and LSI is ready to install. the two USTs, however we will need to be paid for the unexpected removal of Exxon-MobH's
contaminated material. At this time, no one has stepped forward to assume the responsibility for the materials. It .is LSI's position that we did not bring the contaminated material
onto the site, nor did we contaminate it while on the site and therefore we should not be the one to incur the cost ofremoval of the material. It is my understanding that you will pay
for the removal of the contaminated material, providing Exxon-Mobil will agree, in writing, to reimburse you for these W1cxpccted costs related to the installation ofAtlantic's new USTs.
It is very important the Exxon-Mobil realize how critical. this situation has become and requires their immediate attention in order to avoid damage to the utilities and street. The
Town ofAddison has called me several times today expressiug the.ir COTlcem about theirutilities and street. I have assured them that we are working on a solution and will keep them infonned

) Petroleum Storage Tank piercing May 30, 2001 Exxon Gas Station Midway and Beltline Road May 30, Approximately 11 :00 p.m. a construction crew for John Burns Construction company, while
pushing a fiber-optic cable line for AT&T struck a diesel storage tank . When the water from the boring machine entered the tank, an alarm went off, and The construction crew became
aware they had hit something. Eddie Hayse, AT&T's local safety director was immediately called out. Dave Wilde was contacted by Mr. Hayse. That night, the site was excavated down to
where the crews could see the exit puncture of the tank, and plastic was placed over the hole to prevent ground water or more debris from entering the tank. The excavated material was
hauled off-site, and returned to the site the next day. By the next morning, a tanker truck arrived and pumped out 8000 gallons of diesel from the punctured tank. At approximately 8:30
a.m. on May 31, Dave Wilde informed me ofthe incident. I called the TNRCC and was directed to there petroleum storage tank division, and talked to Julian ??????????? and informed her
of the incident. I was instructed to call back later with more information. Once at the site I talked with various representatives of all parties. This included Mark Paddack ofEA engineering,
Eddie Hayse of AT&T and Joe Daughtery of John Burns Construction. All of the parties agreed that there had been no loss ofproduct on site. Mark Paddack, and EA engineering are running
tests on the fill material removed from around the puncture site to check for contamination, and will send me a copy of the results. I called Julian ?????? back at TNRCC and told her
that there didn't appear to be any release offuel, and she said a report would need to be filed with them only if it exceeded 25 gallons, and that it appeared to her that everything
was satisfactory. Later on the afternoon of the 31st, a vacuum truck was brought in to assist in the removing ofthe pea gravel fill from around the puncture site. A tarp was placed over
all the removed removed material, and a orange pedestrian barrier was erected around the entire site. The morning of June 1,2001, Simonne Jones ofExxon Mobil met us at the site to determine
what actions needed to be done. Jim Pierce and myself expressed our concerns that the tanks were located on Town of Addison right of way, and that the area be cleaned up for the Dateline
NBC shooting the following Tuesday. Everyone there agreed that they would remove equipment and traffic control devices, and put plates over any open excavation before then.

curb and parking lot areas of the station not built according to approved plID1S, but that the fuel storage tanks were buried in the Town of Addison right-of-way as well. As per our
letter to Mike Maya, dated June 21,2000, the Town of Addison requires that the site be modified according to the original approved plans, which are attached for your reference. This
includes relocating any and all fuel storage tanks that are currently improperly located in Town of Addison Right-ofWay, as well as removing the existing curb and pavement to the required
6.5 feet from the right-of-way line. This will not only clear the right-of-way, but will also provide green space as initially planned. We require your written response with a course
of action and schedule within 30 days of receipt of this correspondence. Upon receipt of your response, the Town of Addison will review and approve your schedule for performing corrective

throughout the intersection improvement project at Midway Road and Belt Line Road. It has come to our attention during the construction project that the site improvements done at your
Exxon Station in 1996 were not constructed according to approved plans. According to the site plan approved by the Town of Addison, the curb ofyour parking lot on the southeast comer
should be no closer to the right-of-way than 6.5 feet. Based on our investigation it appears that the parking lot was constructed on the new Town of Addison right-of-way. A copy ofthe
approved site plan from 1996 is attached to this letter for your reference. The enclosed site plan was designed to compensate for the current intersection improvements. Had the site
improvements been constructed according to approved plans, only landscape restoration would be required following intersection construction. As a result of construction modifications
to your site plan it is not possible to achieve the landscape improvements indicated in the approved site plan from 1996. The Town of Addison respectfully requests that the Exxon site
