of 􀁾􀁬􀀱􀁧􀁨􀁥􀀠reflective value', and just what the Code says pertaining to this issue. Baaed on our conversation, I understand that there is no set value when evaluating light reflective
valuEI. However, as long as, a contrasting colors are used when between the walk and. the ramp, the City of Addison would be in compliance with the department of Architectural lialltrie::'s
inspections. An example of this you mentioned. was using a da:;-!:: gray on the walk and then a a light gray on the ramp. '. Would you please respond, in writing below, to my summation

Mr. Pierce: It is our understanding that the ROW parcel 6-1-R has still not be obtained by the Town of Addison, We have evaluated the construction sequence at the proposed intersection
of Quorum Drive and Arapaho Road and feel that a minor sequence change will allow EBCC to complete enough concrete removal to provide our retaining wall subcontractor with room to work,
allow for adequate lane widths to accommodate existing traffic, and provide enough grade to construct the concrete pavement to allow a phase 2 traffic switch. We propose shifting the
traffic to the existing southbound lanes of Quorum Drive and removing the pavement for the existing northbound lanes during phase I of the project. The sequence would be reversed for
phase 2. This modification will eliminate the problems caused by past delays acquiring the ROW; however, doesn't eliminate the need for immediate access to that portion of the project.
The wall must be complete prior to beginning excavation and embankment work on the project. Continued delay with this portion of the job will result in delays or further modification
to the construction sequence. Please advise our office regarding the status of this ROW issue. Ifyou have any questions regarding this information, don't hesitate to contact our office.

with phase 1 and 2 of the project; therefore, progress on our contract with the Town of Addison has been essentially suspended since E.L. Dalton started work on the duct bank. Even though
progress has been suspended, our costs for project overhead have continued to mount during the delay. The intent of this letter is to begin a dialogue to recover our costs incurred during
this delay. We feel that the following direct project costs should be reimbursed to EBCC; 1. Traffic switches: As discussed in our weekly meetings, two additional traffic switches were
required on the west end of the project to accommodate TU Electric's work. This work was accomplished with the subcontractor working for EBCC under our contract with the Town. The labor
and equipment charges for each of these traffic switches is $650.00. 2. Barricades: We havc assumed that the barricadc item, item 101, will continue to bc paid during this delay and
the quantity will be increased to include this delay, if necessary. 3. Project Coordinator: We bid this project with a fixed amount for direct project supervision that has been incorporated
in the various bid items. Since the TU Electric work hasn't been incorporated into our contract and none of our bid items have changed, we have no way to reeover our projeet supervision
costs during this delay. I have included our basis of estimate sheets for our direct project supervision costs, as calculated for a full month. We request that EBCC be compensated for
this item on a prorated basis for the duration of the delay. EL Dalton completed all of the available work on our contract prior to starting the TU Electric work; therefore, our project
hasn't progressed since E.L. Dalton started the TU work. As a result, we request that time charges be suspended beginning on the date that E.L. Dalton started work on the TU duct bank.

We have made some progress. John Hill got the agreements for the north side (Chattahochee) back from Atlanta, and Ron signed them this morning. They now will take them to the title company
to get the final deeds done. Ron also signed copies of the agreements with MEPC and John Hill is going to give them to MEPC to sign. I hope to have them back from MEPC next week.

Mr. Pierce: As you are aware our retaining wall subcontractor will need to close the outside northbound lane of Quorum Drive to install the portion of the retaining wall that is parallel
to Quorum Drive. It was our intent to build this wall during installation of the utilities on this project; however, the lack of ROW parcel 6·1·R has limited the amount of the wall that
can be constrncted. Completion of the wall must be accomplished prior to phase I removals, excavation, embankment, and concrete paving. Although our wall subcontractor has constructed
the footer for the portion of the wall that is parallel to Arapaho Road, he has recently reevaluated his schedule and doesn't intend to return until he can build the remainder of the
wall. It appears that EL Dalton will complete phase 1 of their TU Electric work on June 12, 1998 and EBCC could begin removals and excavation work on June 15, 1998. Our crews will not
be able to mobilize and complete phase 1 of the project unless the ROW problem is resolved quickly and our wall subcontractor can remobilize and complete his work. Please adv18e our

crew from laying out the water line and sanitary sewer lines; therefore, E.L. Dalton was compelled to delay their mobilization. Huitt-Zollars completed the center line stakes by the
close of business on April 21, 1998. Based upon that event we scheduled our staking crew for April 23, 1998 and should begin the utility work on April 27, 1998. As a result, we request

3. . Addison agrees to perform the following obligations in connection with the .Project: Addison will design and construct or cause design and construction of, all Project improvements,
both interim and final, in accordan<\e with all Dallas-approved design criteria, plans, .specificatioIllS and construction documents. Addison agrees that if it uses outside j!ntities
to perform design and construction work, it will require any con/!ulting , engineer or construction contractor used to defend, indemnilfy and hold Dallas and Addison harmless from any
claimed personal injury (including death), property damage or other loss for which recovery of damages is allowed that arises out of 01' is occasioned by any breach of the contract or
