As discussed previously there are several items that need to be adjusted to reflect final quantities and a final change order to add several items will need to be processed. The following details describe the differences between the previously paid quantities and the final quantities: I. With regard to the electrical scope ofwork, numerous items (fuurtecn) were adjusted to add the hardware for thc traffic signal pole that was added to the scope ofwork. The conduit and conduit bore items are for the additional work identified at the Addison Road/Arapaho Road intersection. Additionally, the BEGA light pole pay item was adjusted to reflect the three poles delivered to the Town ofAddison and a credit for the foundations was added. 2. The final quantity for Item 130, 3600 psi concrete retaining wall, is 11.14 CY. Enclosed for your review is a copy ofthe measurements used to derive that quantity. 3. The existing striping for the transition between Arapaho Road and the Dallas North Tollway had to be eliminated and then modified to accomplish the desired traffic pattern at that location. Page 2 Arapaho Road Reconstruction Re: Final Billing 4. The final installed quantity for Item 214, Bermuda hydromulch, should be 5191.45 SY. The hydromu1ch was installed at the following location and is detailed on the enclosed plan sheets: Sheet PL-I: three locations on the south side of Arapaho Road in the vicinity of Old Arapaho Road for a total of 1241.44 SY Sheet PL-2: none Sheet PL-3: four locations in the parkways along Quorum Drive and Arapaho Road for a total of 1255.56 SY Sheet PL-4: four locations in the parkway along Arapaho Road and in the southwest corner ofthe Arapaho/Spectrum intersection for a total of 766.67 SY Sheet PL-5: the parkway along the north side ofArapaho and the drainage ditch on the north side of Arapaho for a total of 1888.89 SY Sheet PL-6: the traffic islands on the east side ofthe Dallas North Tollway for a total of 38.89 SY 5. In accordance with our agreement at a November 30, 1999 meeting regarding completion ofthe project, we directed our paver subcontractor to procure Pine Hall pavers as an approved substitute for the Glen Gary pavers that the Town's specified supplier couldn't supply. Enclosed is a copy ofour December 3, 1999 letter documenting our understanding of the agreement including the payment method for the work. Please establish a pay item for the extra cost associated with the Pine Hall pavers for a unit price of$1.85 per SF and a final quantity of 4898 SF. 6. As you are aware, EBCC was directed to remove and reconstruct the driveway at STA 64+22.44 Lt. to conform to the parking lot entrance constructed at the Millennium Park Development. Prior to the original construction ofthis driveway, we attempted to coordinate with Austin Commercial (ACI) regarding this driveway and some adjustruents were made in the field to accommodate their intent. Our survey data indicates that the driveway was in the correct location; however, the constructed dimensions ofthe driveway didn't properly align with the parking lot entrance to Millennium Park. As stated in our earlier meeting regarding close out of this project, it is clear that ACI did not construct their parking lot entrance in accordance with the curb lines indicated on sheet P-7 ofthe plans, that our information obtained in the field regarding the Millennium Park entrance was either incorrect or misunderstood, and that construction ofthe driveway in accordance with our plans would still not have matched AO's entrance. It is our position that EBCC did not possess the information necessary to construct the driveway to conform to ACI's future parking lot construction and ACI made no attempt to "adjust" their parking lot to match the already existing driveway. Based upon these factors, it is clear that the driveway would have needed to be modified based upon ACI's parking lot construction; therefore, EBCC should be compensated for the modifications EBCC was required to implement. Our lump sum price for this work is $6,470.10. Enclosed for your review are our basis of estimate sheets detailing this cost. Page 3 Arapaho Road Reconstruction Re: Final Billing 7. The final quantity for Item 111, monolithic median nose, should be sixteen. The additional median nose is located on plan sheet P-7. The enclosed copy of our final billing reflects our fmal quantities for all ofthe original contract items, the final quantities for change orders one through eight, and the extra work items detailed in this letter. Box 800469 Dallas, Texas 75380-0469 Mr. Roy: Recently I drove the Arapaho Road Project on which your company supplied and installed the streetscape and median trees and groundcover. This letter is to notify you that one ofthe Red Oak trees located on the south side ofArapaho Road and between Edwin Lewis and Addison Road, has died. This tree will need to be replaced within (30) days ofthis notification with a tree that meets the original requirements ofthe project. The replacement tree is covered under the project warranty. During my inspection, I also noticed that several ofthe Foster Holly trees located on the medians are not displaying a dense canopy offoliage. Such was also the case when the project was inspected following the installation, and was such noted in the 'Landscape Inspection-Arapaho Streetscape' document submitted by myselfon September 22, 1999. Additionally, this punch list also made note that the bark ofmany ofthe Foster Holly trees was cracking and exfoliating. These wounds have not healed and could be a contributing factor to the stress that many ofthe trees are exhibiting. Such wounds also open the trees up for insect damage and disease infection. The Town ofAddison Park's Department would like to set a time to visit the site with you and walk the project to discuss how the Foster Holly issue can be resolved. This unique penetrating stain contains methyl methacrylateethyl acrylate copolymer resins and inorganic oxide toning pigments for long term color stability, ultraviolet resistance, alkali and pollution resistance and water-repellency. Toning pigments are chemically suspended in the acrylic resins at all times, thus eliminating settling and color variations on the structure. CANYON TONE STAIN is integrally locked into the substrate as a result of its low viscosity and microscopic penetration properties. It will allow moisture vapor to escape from the building interior under a vapor pressure drive while, at the same time, provides excellent water-repellency on the exterior through the use of hydrophobic resins. BASIC USES CANYON CANYON TONE STAIN was specifically developed as a penetrating stain with waterrepellent properties for use on properly prepared vertical, above-grade smooth or textured concrete, exposed aggregate concrete, glass fiber reinforced concrete, brick, stone, stucco and other masonry surfaces. It is not designed for application to horizontal surfaces. CANYON TONE STAIN corrects natural color imperfections in the substrate by imparting permanent color uniformity plus waterrepellency without disturbing the natural texture of the structure. It will also protect the substrate against atmospheric deterioration. COLORS CANYON TONE STAIN is available in 12 standard natural toned colors. It is also available in white and black as standard. All other earth tone colors are custOm matched by UNITED for the specific application. UNITED has the color tinting IiIcilities to match any color. Color chips or samples must be furnished to UNITED for all custOm colors. CANYON TONE STAIN in standard and custom colors will yield an opaque finish. A translucent, semi-gloss finish can be obtained by blending the stain with Monocryl 50 or 100. This semi-transparent stain will allow certain backgroond aggregate colors to remain visible while uniformly tOning the substrate. The entire surface, however, will be protected by a water-repellent finish. 'Sodium Hydroxide and Ammonium Hydroxide were tested to show CANYON TONE STAIN's resistance to alkaline conditions found in concrete and masonry. Mineral Spirits is commonly used for graffiti removal. ADVANTAGES • Uniformity of Appearance: CANYON TONE STAIN contains a relatively low degree of pigmentation. Depending upon the desired color, a maximum of I pound of toning pigments are used per I gallon (3.8 liters) of finished product. These toning pigments are chemically suspended in solution at all times by a proven process which eliminates settling and color variations on the structure. • Color Retention: Toning pigments used in CANYON TONE STAIN standard colors are laminar silicates, titanium dioxide and inorganic oxides. These non-fading toning pigments are as durable as natural stone and will greatly resist ultraviolet and ozone attack. • No Peeling or Flaking: Properly applied, CANYON TONE STAIN will penetrate and chemically lock into the pores of the concrete/masonry surface. Unlike paint, CANYON TONE STAIN will not flake or peel from the substrate. • Non-Oxidizing: CANYON TONE STAIN does not contain any ingredients that will oxidize, such as vegetable and marine oils, paraffins, stearates or organic pigments which cause rapid degradation and allow moisture intiusion. CANYON TONE STAIN contains pure, non-yellowing methyl methacrylate-ethyl acrylate copolymer acrylic resins. There are no filler resins or plasticizers. • Non-Lapping: Due to its unique acrylic resin formulation, CANYON TONE STAIN will chemically dissolve and blend into itself. This, together with the low degree of pigmentation and sheen, virtually eliminates lapmarks under most application conditions. • Fast drying: CANYON TONE STAIN may be applied in two separate applications within the same hour utilizing only one stage setting. • Single Package: CANYON TONE STAIN is a ready-to-use material after mixing. It has no pot life problems. Shelf life is unlimited. SURFACE PREPARATION r All surfaces must be structurally sound. clean, dry. fully cured. and free from dust, curing agents or fonn release agents, efflorescence, scale or other foreign materials. All previous coatings on the substrate must be completely removed to allow for proper penetration. CANYON TONE STAIN is a natural penetrating stain. It is not designed to fonn a heavy 'paint􀁬􀁩􀁫􀁥􀁾􀀠film. If CANYON TONE STAIN is unable to penetrate, it will fonn a surface film. Surfaces such as glazed or dense brick, glass fiber reinforced concrete, and smooth dense concrete must be sweep sandblasted prior to application of CANYON TONE STAIN to allow for maximum penetration. Although CANYON TONE STAIN has been used successfully on numerous recoat projects over a wide range of existing paints and coatings, a test area should always be applied to verify compatibility. CANYON TONE STAIN will provide the same color stable, water-repellent properties, however. adhesion to the substrate will depend on the bond of the existing paint or coating. It is suggested that UNITED COATINGS' Technical Service Department be contacted for recommendations prior to application of CANYON TONE STAIN on any substrate where there is any doubt as to the ability of CANYON TONE STAIN to properly penetrate that particular substrate. APPUCAT.lON CANYON TONE STAIN may be applied by roller or airless spray equipment. Any airless spray equipment capable of 1,000 psi (6,980 kPa) and 'Ii gallon per minute (1.9 IIminute) delivery can be used for applying CANYON TONE STAIN. For maximum production on large projects. airless spray equipment capable of 2,000 psi (13. 780 kPa) and I gallon per minute (3.8 IIminute) delivery can be used. A reversible self-cleaning spray tip with orifice size of .013" to .017" (.330 to .415 millimeters) and minimum 40 degree fan angle is recommended. Brush or roller application is recommended only for edging work and for confined areas which would require extensive masking or protection from spray during application. When applying CANYON TONE STAIN with a brush or roller, exercise care so as not to apply material at a coverage rate which exceeds that which has been spray applied. If two separate applications are applied utilizing two or more methods of application, and different coverage rates for each method, variations in the finish sheen could result. Refer to Table 3 on Estimated Coverage Rates for type of substrate and approximate total coverage rate per gallon. The coverage rates listed are the approximate total for two (2) separate applications. These figures are provided for guideline use only. CANYON TONE STAIN shall be applied in a minimum of two separate applications. The first application shall achieve an indepth penetrating color base. The second application shall achieve color uniformity, aesthetic satin tone and waterrepellency. The second application can be applied as soon as the first application is dry. Exceptionally coarse andlor porous substrates may require a third coat of CANYON TONE STAIN to achieve uniform color and sheen. When applying CANYON TONE STAIN blended with MonocryI SO or 100 to achieve a translucent appearance, care must be taken to taper and blend the material at the lap lines. Each application shall flfst be in a unifonn horizontal direction, followed by a unifonn overlapping vertical direction. When applying CANYON TONE STAIN to ribbed, fluted, split face or other textured finishes, care must be taken to apply the stain from various angles to ensure that all surfaces are evenly coated. Gun shall be held perpendicular to and not more than 18" from the wall. Care should be taken during application to prevent runs or sags. Backrolling is an effective method of achieving hide over coarse or porous surfaces. The Applicator should apply a field test on a small, inconspicuous area of the actual building surface to determine the best absorption rate to achieve color uniformity. Refer to paragraph entitled Sample Area Application. Clean equipment with Xylol. Mineral Spirits should be left in lines and pump for storage. SAMPLE AREA APPLICATION UNITED recommends that a sample area application be applied by the Contractor, using the desired CANYON TONE STAIN color. Approval shall then be obtained prior to any general application of the material. Sample application shall be conducted on an inconspicuous area on the actual building (minimum 50 square feet) (3.7 ml ). Applying the desired CANYON TONE STAIN color to a sample area will determine the best absorption rate to achieve color uniformity, as well as determine suitability of the application technique employed. Final appearance is affected by absorption rate, surface texture and color, porosity of the substrate and application technique. For theSe reasons, written approval should be obtained from the Architect and/or Building Owner prior to proceeding with the general application. Approved sample area shall serve as a standard of comparison with respect to color and overall appearance. APPLICATION TIPS Whenever CANYON TONE STAIN is ordered by a customer, every effort is made to send all containers of the CANYON TONE STAIN color in the same batch number. However, due to fluctuations in inventory levels, there are occasions when different batch numbers of the same color are sent to complete an order. Whenever this occurs, it is the sole responsibility of the CANYON TONE STAIN Applicator to make certain that only one batch number is used on any side of the building. Different batch numbers cannot be used on the same wall unless they are "boxed" or mixed together to insure total color uniformity. When pre-cast panels or GFRC panels are stained at the factory and later constructed at the building jobsite, the Contractor must be certain that all panels attached on one side of a building are stained with the same batch number of CANYON TONE STAIN. Material shall be thoroughly mixed for a minimum of five (5) minutes prior to application. Do not thin the material. Use an air-operated or other explosion-proof mixer. which has been grounded and bonded, with a blade capable of uniformly mixing the entire container. Periodically agitate the material during application to ensure even distribution of the pigment. Shelf life in unopened containers is unlimited. Material should be stored at temperatures no lower than 20°F (-6°C), or higher than 100°F (38°C). Do not open containers until ready to use the material. UMITATIONS & PRECAUTIONS CANYON TONE STAIN should not be applied over damp surfaces or used over wood. Test areas should be applied over any sound. existi1)g painted surface to determine compatibility. Do not apply CANYON TONE STAIN at temperatures below 4Q°F (5°C). CANYON TONE STAIN is a low viscosity material designed to provide color uniformity and water-repellency without disturbing the natural texture of of the substrate. It is not designed to lill or waterprouf porous substrates under wind driven rain or other severe conditions. For applicatious requiring waterproofing, a membrane-forming coating such as UNITED's Aquathon or Uni-Tex should be utilized. CANYON TONE STAIN overspray can be cleaned off of glass and most other surfaces with Xylol, followed by a soap and water wash. Solvents are flammable in their liquid state. Use only in a well ventilated area. Keep away from heat, sparks and open flame. On interior applications extinguish all flames and pilot lights in and near the work area. During application and until vapors are gone, refrain from using electrical switches or equipment unless they are U.L. designated explosion-proof. No smoking shall be allowed in or near the immediate work area. Use explosion proof equipment which has been grounded and honded. Avoid breathing of vapor or spray mist. For exterior applications, approved (MSHAINIOSH) chemical cartridge respirator should be worn by Applicator. For interior applications, provide mechanical exhaust ventilation. Air line masks or positive pressure hose masks should be worn during interior applications. The claim is based upon several incIdents in which our utility subcontractor feels he was delayed or required to do additional work: Item 1: Standby time while several Southwestern Bell facilities were adjusted to miss the storm sewer lines. Our cost for these delays is $2,200.00. Item 2: An existing SWB duct bank was installed to close to the proposed storm sewer system. During installation ofthe storm sewer the bell was broken off of the SWB duct bank. Our utility subcontractor was required to repair the duct bank and clean the mud out ofthe duct bank. This situation would not have occurred ifthe duct bank was installed with enough clearance to properly install the storm sewer. Our cost for repairing and cleaning the duct bal}k is $1,075.00. Item 3: Downtime while waiting for various lines to be lifted out ofthe way so that storm sewer could be laid. Our cost for this delay was $850.00. Our utility subcontractor has made two additional claims; however, we intend to gather additional facts regarding those incidents prior to forwarding the claims to your office. SCOPE OF WORK The Work: fur this Project consists offumishing all materials, labor, equipment, tools and incidentals necessary to construct, in accordance with the Plans and Specifications, the proposed paving, stormwater, water, wastewater, signalization, streetscaping, and miscellaneous improvements for Arapsho Road from Addison Road to Dallas North Tollway. 11. PROPERTY LINES AND MONUMENTS All property corners, control monumentations, construction and survey stakes and marks shall be carefully preserved by the Contractor, and in case of careless destIUction or removal by Contractor or his employees, such stakes or marks shall be replaced at the Contractors expense as required by the Owner. 12. 􀁄􀁉􀁓􀁃􀁒􀁅􀁐􀁾􀁃􀁉􀁅􀁓􀀠If the Contractor, in the course of the Work:, finds any discrepancy between the Contract Documents and the physical conditions of the locality, or any errors or omissions in drawings or in the layout as given by survey points and instructions, or if it appears that any Plan, Specification or other Contract Document is or may be not in compliance with any building code or other requirement ofany governmental body, he shall immediately inform the Owner in writing, and the Owner shall promptly verify the same. EXISTING UTILITIES AND SERVICE LINES The Contractor shall contact all the utility companies which have facilities in theI vicinity of the proposed improvements to confirm the horizontal and vertical locations of their respective facilities prior to commencing work. Where a conflict with the proposed improvements is encountered, the Contractor shall notify the Engineer • immediately prior to proceeding with the work. The Contractor shall be responsible for the protection of all existing utilities or service lines crossed or exposed by his construction operation. Where existing utilities or service lines are cut, broken or damaged, the Contractor shall replace the utilities or service lines with the same type oforiginal construction, or better, at his own cost and expense. All replacement, backfill and compaction shall be accomplished in strict accordance with the requirements ofthe owner'ofthe utility or service line. 16. PUBLIC UTILITIES AND OTHER PROPERTY TO BE CHANGED In case it is necess!lI)' to change or move the property of any owner or of a pUblic utility, such property shall not be moved or interfered with until authorized by the utility company and approved by the Owner. The right is reserved to the owner of public utilities to enter upon the limits ofthe Project for the purpose of making such changes or repairs ofthis contract. 17. LIGHTS AND POWER The Contractor shall provide, at his own expense, tempo!!lI)' lighting and power facilities required for the proper execution ofthe Work. 18. PERMITS AND RIGHTS-OF-W.AY The Owner will provide rights-of-way for the purpose of construction without cost to the Contractor by securing permits in areas of public dedication or by obtaining easements across privately-owned property. It shall be the responsibility of the Contractor, prior to the initiation of construction on easements through private property, to inform the property owner of his intent to begin construction. The Hunter roto'r heads shall be furnished by the Town for installation by the contractor. The contractor shall be paid for installing the rotor heads as per Item No. 531 of the contract. We believe the price to upgrade the controller from a 12 station to a 36 station is too high. Robert stated he was working with the subcontractor to reduce the price. Below is a list ofproblems that I observed; I met with Pat of Ed Belle Construction and pointed them out to him, 1) One Red Oak on the south and one on the north side of Arapaho had vigorous sap flow occurring from the trunk. 2) One Red Oak on the north side ofArapaho between the entrance into the DART Center and Quorum had all of its leaves wilted and desiccated, 3) Many of the Red Oaks on both sides of Arapaho are not centered in the tree grates. 4) Several ofthe Foster Hollies have either browned or dropped all or a large percentage of their leaves. How soon will the SE radius at Addison Rd. be put in? The delay is causing a serious failure ofthe pavement in Addison Rd. that may soon require the closing of the right-hand NB lane. Along with this is the hot -mix repair along the connection with the new concrete. Some questions I'm sure Pat will want answered are: 1. When will the power be relocated and the poles removed on Quorum? 2. When will SWBT remove or cut their line on Spectrum? Some Questions I have are: 1. Is there a list of days allowed for utility conflict to this pOint? 2. When will the next traffic switch take place? 3. Is there anything specifiC that I need to do beyond what I am doing now, orthat I can do better?
