This is retail cost and the city gets 40% off of this; a contractor should get at least 30%. I believe Pat now has a complete understanding of our problems. Pat has indicated to me that he is willing to take care ofthis problem once and for all through surveillance, proper plating and keeping up with the repairs needed before serious problems develop. Ifthis is the case, and if the Town does not have to respond to repair potholes on this project in the future, then the Town is willing to forgo charges to Ed Bell Construction for the ahove responses. Ifthis is not the case, and the Town does have to respond, charges for all past and future events will be assessed. The reasons for the high priority are the elimination ofa severe bottleneck, and, more importantly, the new road is needed to service the new DART Transit Center that is currently under construction and ahead of schedule. The Town is committed by written agreement to provide the completed road for DART when the transit center is completed. About mid Augnst, we discovered a conflict with one ofyour underground duct banks and a storm sewer required for our project. On August 25, our staff met with your staffin the field and we were told that plans would be prepared and that the relocate would take place in about 2 months. We now discover that the plans were completed only in late Oetober, and that the SWBell relocate work has not been funded. We find this situation to be unlike the previous cooperation we have received from SWBeli on this project, and due to time commitments, cannot accept any further delay on the part ofSWBeH. The following was observed: Near the intersection ofArapaho and Spectrum: • "Bow shaped" saw joint • Very shallow sawcuts • Some joints not cut • Some sawcut joints not aligned properly ( "Y" shaped cuts) • Sawcuts carelessly made into median noses and curbs • Panels longer than 12' (sawcuts should be made every 12') • Core test hole not plugged and full ofwater • Crosswalks cracked due to lack ofcontrol joints (includes crosswalk at Edwin Lewis Drive and Arapaho) At the Quorum intersection: • Many cracks in the concrete poured by N. As you know, we have had several complaints, including one that came through the City Manager's office, regarding potholes in the construction area. In order to remedy the situation, Ed Bell Construction agreed to inspect the job each morning and perform the necessary maintenance for the convenience and safety ofthe travelling public (barricade maintenance should also be included). ' Ifthe Town discovers potholes in need ofrepair, the Town shall notityEd Bell Construction ofthe location and shall expect repair work to begin within 2 hours ofsuch notice. IfEd Bell Construction cannot, or does not respond within the two-hour period, the Town will dispatch a crew to make the repair. Inorder to remedy the situation, Ed Bell Construction agreed to inspect the job each morning and perform the necessary maintenance for the convenience and safety ofthe travelling public (barricade maintenance should also be included). lfthe Town discovers potholes in need ofrepair, the Town shall notify Ed Bell Construction ofthe location and shall expect repair work to begin within 2 hours ofsuch notice. lfEd Bell Construction cannot, or does not respond within the two-hour period, the Town will dispatch a crew to make the repair. Inthis case, the Town will charge Ed Bell Construction for the Town's cost, estimated to be $100 per repair during normal working hours. After hours, labor charges are at time and one-half.
