DBEJMBE Requirements: All bidders and proposers shall make good faith efforts, as defined in Appendix A of 49 CFR Part 23, Regulations of the Office of the Secretary of Transportation, to subcontract 15 % of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged include women, African-Americans, Hispanics, Native Americans, Asian-Pacific Americans, and Asian-Indian Americans. The apparent successful bidder (proposer) will be required to submit information concerning the DBE's that will participate in this contract. The bidder will be required to establish to the satisfaction of the Owner and the Consultant the reliability and responsibility of the proposed Subcontractors and suppliers to furnish and perform the Work. O. AWARD: The Owner reserves the right to accept any or to reject any bids without compensation to bidders and to waive irregularities and informaIities. The Consultant, in making his recommendation, will consider the following elements: I. Whether the bidder is a contractor with experience in the type of work involved. 2. Whether the bidder has adequate piant, equipment and personnel to perform the work properly and expeditiously. 3. Whether the bidder has a suitable financial statua and reputation for meeting obligations incident to work of the kind specified. P. EXECUTION OF THE CONTRACT: The successful biddel-will be required to enter into a contract with with the Owner within ten (10) calendar days of notice by the Owner that his bid has been accepted. Loop wire through hoSe and route both around crotch of major branch. Securely fasten loose ends at T -post by twisting together. Pruning of New Trees: Prune trees to preserve natural character of plant in a manner appropriate to its particular requirements in the landscape design as . directed by Architect/Owner. In general, never remove greater than one-third of wood by thinning. Do not cut back terminal branches. Remove sucker growth and broken or badly bruised branches.
